When Donald Trump left office, we had restored operational control of our southern border. The wall was nearing completion. Court ordered deportations were finally being enforced. The Migrant Protection Protocols negotiated with Mexico had reduced the number of fraudulent asylum claims to a trickle.
All that Biden needed to do was to continue these policies. Instead, he reversed them on his first day in office. He ordered the border wall to be abandoned, leaving construction gaps that make it useless. He ordered ICE to cease enforcing the law. He ended Trump‘s remain-in-Mexico policy. And he sent a clear and unmistakable message heard around the world: America is now a nation without borders.

DHS Secretary Ali Mayorkas has repeatedly asserted – including in sworn testimony to this committee -- that the southern border is secure. This, of course, is a lie and not even a subtle one.

Eighteen months ago, we had achieved operational control of our Southern Border. The border wall was nearing completion. The remain in Mexico policy and enforcement of court-ordered deportations had slowed illegal migration to a trickle. American workers were finally seeing major wage gains and the gap between rich and poor in this country was finally narrowing.
All that ended on January 20, 2021, when Joe Biden cancelled the Remain in Mexico policy, ordered ICE to stop enforcing court-ordered deportations and cancelled the border wall, leaving construction gaps through which thousands of illegal immigrants pass every day.

President Biden hasn’t mentioned Afghanistan since he turned the phased, conditional withdrawal under Trump into an unconditional surrender to the Taliban. Nor has he yet found the time to see the chaos his policies have produced by collapsing our southern border.

WASHINGTON, D.C. – Today, Congressman Tom McClintock (CA-04), Ranking Member of the House Judiciary Subcommittee on Immigration and Citizenship, introduced the Illegal Immigrant Payoff Prohibition Act of 2021. House Republican Leader Kevin McCarthy and House Judiciary Committee Ranking Member Jim Jordan are principal co-sponsors. The legislation will prevent the Attorney General from making settlement payments to individuals and families who entered the United States illegally. It is a direct response to reports that the Biden Administration is proposing to pay as much as $450,000 per person to compensate families that unlawfully entered the United States.

Today we will hear from Dr. Ronil Hira of the damage done to American workers – and to the foreign workers themselves -- through abuses in guestworker programs like H-1B, L-1 and the Optical Practical Training program, and how despite assurances of the left, pay far below the market rates for labor and displace skilled American workers. This has resulted in continuing scandals as skilled American workers have been ordered to train their foreign replacements as a condition of receiving severance pay, including major corporations like Southern California Edison, Siemens, Disney, AT&T and the University of California. Under the OPT program, employers don’t have to pay payroll taxes if they hire foreign nationals here on student visas for 29 months after graduation. If you know a college graduate who has a science, technical, engineering or mathematics degree who can’t find an entry level job, you need look no farther than this discriminatory program.

We are way beyond any question of whether we face a border crisis – the question now is whether we have a border at all. When I put that question directly to the President of the Border Patrol, his answer was an emphatic NO.
