This October crisis is punctuated by three developments that are becoming increasingly obvious and disturbing. The first is the refusal of the Senate and the President to resolve their differences with the House through negotiation and compromise on the one bill that would fund this government and end this shutdown.

The debt limit exists for a simple reason: to assure that public debt isn't recklessly piled up without Congress periodically acknowledging it and addressing the spending patterns that are causing it. If a debt limit increase is supposed to be automatic, as the President suggests, there really is no purpose to it. A new dimension has now appeared in this discussion. Unlike every one of his predecessors, this President has vowed that unless Congress unconditionally raises the debt limit, the United States will default on its sovereign debt.

Congressman Tom McClintock today introduced HR 3188, the Yosemite Rim Fire Emergency Salvage Act. The measure provides for the expedited salvage of fire-killed timber in the Stanislaus National Forest and the Yosemite National Park by waiving environmental regulations and litigation that often delay salvage operations until the timber becomes worthless.

In the early 1760's the Royal Governor of Massachusetts began issuing "writs of assistance" as general warrants to search for contraband. They empowered officials to search indiscriminately for evidence of smuggling.

Under the Fourth Amendment, if the Government wants to snoop through a person's email, it must first convince a judge that there is probable cause to believe that person has committed a crime and it must specify the documents it believes are relevant to that charge. Yesterday the House passed a measure that makes a mockery of this cherished protection.

I remember when we met here in Auburn in April of 2010 under imminent threat of closure, all the "experts" said that the only way to keep the Auburn Project Area lands open would be with massive federal earmarks. I am pleased to note that today's announcement is the result not of federal earmarks, but rather of re-ordering federal priorities
